Terms of Service
Effective 13 October 2026
- Inferify is a tool for qualified regulatory professionals. It helps you review evidence and draft CER updates; it does not make regulatory, clinical or legal decisions, and you must check everything it produces.
- Your documents stay yours. We use them only to run the service for you, and we never use them to train AI models.
- AI features run on your own Anthropic API key and account. You pay Anthropic directly for that use.
- The service is in early access and provided as is. Our liability is limited, and disputes are resolved individually by arbitration.
1. Agreement
These Terms of Service (the “Terms”) are an agreement between you and Poojak Patel, doing business as Inferify (“Inferify”, “we”, “us”). They govern your access to and use of the Inferify website, application and related services (the “Service”). By creating an account, checking the box at sign-up or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
The Service is for business and professional use only. If you use it on behalf of a company or other organization, you confirm that you have authority to accept these Terms for it, and “you” includes that organization. You must be at least 18 years old.
2. Early access
The Service is offered by invitation, as an early-access product. Features may change, be limited or be removed, and the Service may contain errors or be unavailable at times. We do not promise any particular level of availability, support or performance, and we may suspend or end early access at any time.
3. What the Service is, and what it is not
Inferify is software that helps regulatory and clinical affairs professionals compare a Clinical Evaluation Report (“CER”) with supporting evidence they upload, link claims to passages in those documents, and draft proposed text for their review.
Inferify is a drafting and review aid. It is not, and you agree you will not treat it as:
- regulatory, legal, clinical or medical advice;
- a determination of compliance or conformity with the EU Medical Device Regulation (2017/745), FDA requirements or any other law, standard or guidance;
- a medical device, or software intended for diagnosis, treatment or any clinical decision about a patient;
- a substitute for the independent judgement of a qualified clinical evaluator, regulatory professional or notified body.
You are solely responsible for the content of every CER, report, submission and other document you prepare, sign, issue or submit, whether or not you used the Service to prepare it, and for every regulatory, clinical and business decision you make. We make no representation that any output will be accepted by a notified body, competent authority or other regulator.
4. AI-generated output
The Service uses artificial intelligence to extract claims, assess evidence and draft text (“Output”). AI can be wrong, incomplete, out of date or misleading, even when it cites a source, and the Service’s source checks reduce but do not eliminate these risks. Output may also resemble output produced for others.
You agree to review every Output, verify it against the underlying sources and correct it before relying on it or including it in any document. You will not represent Output as having been produced or verified by a human unless a qualified person has done so. As between you and us, you own the Output generated for you, to the extent any rights exist in it.
5. Your Anthropic API key
AI features run on an Anthropic API key that you provide. When you add a key, you authorize us to use it to send requests to Anthropic on your behalf, including relevant excerpts of your documents, solely to provide the Service to you.
- Your use of Anthropic is governed by your own agreement with Anthropic, including its usage policies and data terms. You are responsible for complying with them and for all charges Anthropic bills to your account, including charges from analyses you start that fail, time out or are repeated.
- We store your key encrypted and use it only for requests you initiate in the Service. You are responsible for the key you provide and for revoking or replacing it (in Company Settings and in your Anthropic account) if you believe it has been exposed.
- Anthropic is an independent third party. We are not responsible for its services, availability, pricing, data handling, or any change to or interruption of them.
6. Accounts and security
You must give accurate information, keep your password confidential and tell us promptly at legal@inferify.io about any unauthorized use of your account. You are responsible for all activity under your account and in your workspace. Accounts are personal; do not share login credentials.
7. Your content
You keep all rights in the documents, data and other material you upload or enter (“Customer Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Customer Content only as needed to provide, secure and support the Service for you, including sending excerpts to Anthropic under your API key. We do not sell Customer Content and we do not use it to train AI models.
You represent and warrant that you have all rights, licences, consents and authority needed to upload Customer Content and to have it processed as described in these Terms and our Privacy Policy, and that doing so does not breach any law, contract or confidentiality obligation.
The Service is not designed to hold patient-identifiable health information. You agree not to upload protected health information as defined by HIPAA, or personal data concerning health of identifiable individuals, unless it has been de-identified or anonymized. We do not sign business associate agreements.
You are responsible for keeping your own copies of Customer Content. The Service is not a backup or archival system or a regulated document management system.
8. Acceptable use
You will not, and will not allow anyone else to:
- access or attempt to access another workspace’s data, or probe, scan or test the Service’s security without our written permission;
- upload malware or material that infringes others’ rights or that you have no right to share;
- interfere with or overload the Service, or use it to build a competing product;
- copy, modify, reverse engineer or decompile the Service, except where the law expressly permits it despite this restriction;
- resell, sublicense or provide the Service to third parties, other than members of your own organization;
- use the Service in breach of any law, including export control and sanctions laws, or of Anthropic’s usage policies.
9. Fees
The Service is currently provided without charge during early access (Anthropic usage is billed to you by Anthropic). We may introduce fees in the future. We will tell you before any fee applies to you, and you will not be charged unless you agree.
10. Our intellectual property and feedback
We and our licensors own the Service, including its software, design and documentation. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for your internal business purposes while your account is active. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
11. Third-party services
The Service relies on third-party providers, including Supabase (authentication, database and file storage), Vercel (hosting), Resend (email) and Anthropic (AI, under your own key). Their services are subject to their own terms. We are not liable for their acts or omissions, or for outages, data loss or security incidents that originate with them, except to the extent caused by our own breach of these Terms.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Service and all Output are provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied or statutory, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness or quiet enjoyment, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure or error-free, that Output will be accurate, complete or acceptable to any regulator, or that any defect will be corrected.
13. Limitation of liability
To the maximum extent permitted by law: (a) in no event will Poojak Patel, doing business as Inferify or its affiliates, contractors or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or anticipated savings, cost of substitute services, regulatory penalties or fines, product recalls, delays or rejections of regulatory submissions or certifications, or charges billed by Anthropic or other third parties, arising out of or relating to these Terms, the Service or any Output, however caused and under any theory of liability (contract, tort including negligence, strict liability or otherwise), even if advised of the possibility of such damages; and (b) our total aggregate liability arising out of or relating to these Terms, the Service or any Output will not exceed the greater of the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, and one hundred US dollars (US$100).
These limitations are an essential part of the bargain between us and apply even if a limited remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law, such as liability for fraud or, where the law so provides, for gross negligence or wilful misconduct.
14. Indemnity
You will defend, indemnify and hold harmless Poojak Patel, doing business as Inferify and its affiliates, contractors and licensors from and against any claims, damages, losses, liabilities, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) Customer Content; (b) any document, submission, decision or product that you or your organization prepared, issued or made using the Service or any Output; (c) your use of your Anthropic account and API key; or (d) your breach of these Terms or of applicable law. We will notify you of any such claim and may participate in its defence with counsel of our choice at our own expense.
15. Suspension and termination
You may stop using the Service and ask us to delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. On termination your right to use the Service ends. We will delete Customer Content within 30 days of account deletion, except where we must retain it by law; download anything you need before then. Sections 3, 4, 5, 7 (last two paragraphs) and 10 to 18 survive termination.
16. Disputes: arbitration and class action waiver
Please read this section carefully. It affects your rights.
Before filing any claim, you agree to contact us at legal@inferify.io and try to resolve the dispute informally for at least 30 days.
If it is not resolved, any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator. The arbitration will be conducted in English, by video conference or on written submissions unless the arbitrator decides an in-person hearing is necessary, in which case it will take place in Wilmington, Delaware. Judgment on the award may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small claims court, and either party may seek an injunction in court to protect its intellectual property or confidential information.
Claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. To the extent any claim proceeds in court, each party waives its right to a jury trial.
Any claim must be brought within one (1) year after it arose, or it is permanently barred, to the extent the law allows such a limit.
17. Governing law
These Terms are governed by the laws of the State of Delaware, USA, and applicable US federal law, including the Federal Arbitration Act, without regard to conflict-of-laws rules. Subject to Section 16, the state and federal courts located in Delaware have exclusive jurisdiction, and both parties consent to their jurisdiction. The UN Convention on Contracts for the International Sale of Goods does not apply.
18. General
- Changes. We may update these Terms. We will give at least 14 days’ notice of material changes by email or in the Service, unless a change is required sooner by law or to address a security risk. Continuing to use the Service after a change takes effect means you accept it.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the Service and replace any prior understandings.
- Severability and waiver. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect. Not enforcing a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our written consent. We may assign them, including to a company we form to operate the Service or in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of third-party providers, internet failures, natural disasters, strikes or government action.
- Relationship. We are independent contractors. Nothing in these Terms creates a partnership, agency, employment or fiduciary relationship.
- Notices. We may send notices to the email address on your account. Send notices to us at legal@inferify.io.
